1.      What is this Privacy Policy about?

This privacy policy (further – Privacy Policy) describes to you, our client, end-user or visitors of internet site http://www.claimscontrol.com/how (further – Internet site) how we, Claims Control UAB, company code 304895923, registration address Buivydiskiu str. 118, Zujunu village, Vilnius region, the Republic of Lithuania  (further – ClaimsControl) process your personal data which you provide after visiting our Internet site, through ClaimsControl mobile application or ClaimsControl social media accounts, after contacting us via e-mail phone, also your personal data which ClaimsControl gains while performing contracts with partners or clients legal entities, if you are an employee or a representative thereof.

This Privacy Policy is not applicable in cases where ClaimsControl acts as a personal data processor.

2.      What kind of your personal data and on what basis do we process?

We may process the following information:

  • For the purpose of improving our Internet site, analysing of marketing campaigns (use of cookies) we process IP addresses of our Internet site visitors, also data about visiting. Such data are processed on the basis of your consent. You will find more information about the use of cookies in the section “What kind of cookies are used on this Internet site?”.
  • For the purpose of performance of contracts with ClaimsControl clients legal entities and partners legal entities we process on the basis of legitimate interest the following data of employees and representatives of our clients and partners: name, surname, contact data, title, communication data, other data received during the performance of the contract.

Your personal data processed for the purposes of performance of the contracts with ClaimsControl clients and partners will be stored 10 (ten) years after the end of the provision of the services and the period until upcoming 7th of January, except the cases where laws and (or) other legal acts establish longer storage period.

  • If you enter into a service provision contract with ClaimsControl, (i.e. check the box that you agree with General Terms on Usage of Platform, we process your personal data for the purposes of service provision and administration. We can process the following personal data: name, surname, birth date, contact data (e-mail, telephone number), IP address, bank account data; depending on the type of service provision, we may collect information about:

– in the cases of administration of transport vehicles insurance events – name of an insurance company to which you wish to provide the report, nature of event, information whether you are the victim or the causer, information whether a human, transport vehicle or another object has experienced damage during the event, information about your transport vehicle and the other transport vehicle that was present in the event (their owners, registration numbers, brand, model), insurer, insurance broker, number of insurance policy, date and place of event, coordinates, other details of event; data about the causer of the event, contact data about the reporter and his insurer, information about damage, information whether the event was reported to emergency services, information whether you were the driver, your bank account data, wheter you require monetary compensation of repair of transport vehicle at the service and which service, information about reimbursement of insurance compensation and whether case is closed; we may also process other personal data which you provide in the pictures of transport vehicles, police reports, explanation of the driver or otherwise by ordering or using our services;

– in the cases of administration of civil liability insurance events – name of an insurance company to which you wish to provide the report, nature of event, insurer, insurance broker, number of insurance policy, date, and place of event, other details of event; data about the causer of the event, contact data about the reporter and his insurer, information about damage, information whether the event was reported to emergency services, bank account data, information about reimbursement of insurance compensation and whether case is closed; we may also process other personal data which you provide in the documents or otherwise by ordering or using our services;

– in the cases of administration of property insurance events – name of an insurance company to which you wish to provide the report, nature of event, insurer, insurance broker, number of insurance policy, date, and place of event, other details of event; data about the causer of the event, contact data about the policyholder, information about damage, information whether the event was reported to emergency services, bank account data, information about reimbursement of insurance compensation and whether case is closed; we may also process other personal data which you provide in the documents or otherwise by ordering or using our services;

– in the cases of administration of travel insurance events – name of an insurance company to which you wish to provide the report, nature of event, insurer, insurance broker, number of insurance policy, date and place of event, other details of event; information whether the event was reported to emergency services, bank account data, information about reimbursement of insurance compensation and whether case is closed; we may also process other personal data which you provide in the documents or otherwise by ordering or using our services.

– in the cases of administration of health insurance events – name of an insurance company to which you wish to provide the report, nature of event, insurer, insurance broker, number of insurance policy, date and place of event, other details of event; information whether the event was reported to emergency services, bank account data, information about reimbursement of insurance compensation and whether case is closed; we may also process other personal data which you provide in the documents or otherwise by ordering or using our services.

The above data are processed on the basis of performance of the contract and (or) obligations set out by laws and (or) legitimate interest due to the necessity to perform the contract.

Your personal data for the purposes of service provision and administration purposes will be stored 10 (ten) years after the end of the provision of such services and the period until 7th of January, except, except the cases where laws and (or) other legal acts establish longer storage period.

  • For the purpose of direct marketing, we process your personal data on the basis of legitimate interest and (or) your consent.

If you, at the time of entering into agreement with us, did not express clear objection on processing your personal data for the purposes of direct marketing, we on the basis of legitimate interest, aiming to contact you and to provide you with information about Claims Control services or offers, can process your personal data (name, surname, title, e-mail) for the purposes of direct marketing and send you newsletters or offers via e-mail.

Each time upon receipt of direct marketing messages (etc. newsletter), you will be provided with a possibility to refuse direct marketing messages by notifying us via e-mail or other convenient ways. We may collect statistical information about the newsletters that we sent: we observe whether you have read it, when and how many times you read or opened it, whether you forwarded it to others, which operating system and server (place) for e-mail you use.

In the cases where we process your personal data on the basis of the legitimate interest of ClaimsControl, your personal data are stored during the validity of the related service agreement.

In the cases where we process your personal data on the basis of your consent, we store your personal data 5 (five) years after receiving consent from you and the period until upcoming 7th of January.

  • Any other personal data that you can provide to us at any time while communicating with us – writing us an e-mail, mail or calling by phone. Such data will be processed on the basis of your consent and stored 2 (two) years after receiving your consent and the period until the upcoming 7th of January.

We would like to pay your attention that if you do not provide certain personal data to us, we may be unable to provide our services to the full extent.

  • to get acknowledged with your personal data that we process and the following information: purposes of personal data processing, categories of respective personal data; personal data recipients or categories of personal data recipients whom your personal data have been disclosed or may be disclosed in the future; where possible, foreseen period of your personal data storage or, when impossible, with criteria applicable for establishment of storage period;
  • to request rectification of imprecise or supplementation of incomplete personal data of yours;
  • to request the deletion of your personal data. We are obliged to perform your request: i) upon existence of legal ground, for instance, if personal data are not required anymore to achieve aims for which personal data had been collected or otherwise processed; ii) you decided to revoke your consent on processing of your personal data, where your personal data have been processed on the exclusive basis of your consent and there is no other ground for processing of your personal data. Hereby we would like to pay your attention that we will delete your personal data from your account and will request that personal data processors that have been engaged by us would do the same. However, in order to delete your personal data from accounts of personal data controllers you have to apply directly to these personal data controllers.

6.      How can you enforce your rights?

We will respond to your requests, claims or requests and will provide the required information within the terms and order established by laws as soon as possible but not later than within 30 (thirty) days as of receipt of your request. In exceptional cases, we may extend this deadline by an additional 30 (thirty) days. In such events, we will notify you.

Before proceeding with your request or replying to you, we may ask you to provide a document proving your personal identity.

If you are considering that your personal data are processed illegally or your rights related to the processing of your personal data are infringed, you are entitled to apply to the competent authority in your country and provide your claim.

7.      How this Privacy Policy can be changed?

We may renew or amend this Privacy Policy at any time. Such renewed or amended Privacy Policy will come into force as of its publication on the Internet site.
